These Terms are applicable to all Contracts of any kind made by Jannah Hotels & Resorts and its clients (“the Clients”) and apply to all reservations, bookings and agreements for accommodation, dining, function room hire and use of all services at Jannah Place. Clients are invited to read these provisions and note their responsibilities, arrangements for payments, cancellation terms and limitations on the liability of Jannah Hotels & Resorts. The Contract is conditional on the payment of the Deposit.

“Arrival” – means the date on which the Services are to be provided or shall start to be provided by Jannah Hotels & Resorts;
“Client” – means the person for whom Jannah Hotels & Resorts has agreed to provide the Services in accordance with these Terms;
“Contract” – means the contract for the provision of the Services including these Terms as appropriate;
“Services” means the provision of accommodation, function room hire and/or supply of food and beverages and other Services by Jannah Hotels & Resorts for the Client described in writing by Jannah Hotels & Resorts and on its website or in its brochure;
“Standard Charges” – means the charges shown in any brochure of Jannah Hotels & Resorts or other published literature relating to the Services in force from time to time;
“Terms”- means these terms and conditions;
“Event” means an event which takes place in one of the Hotel’s areas;
The headings in these Terms are for convenience only and shall not affect their interpretation.

TERMS OF SUPPLY INTERPRETATION

PROVISIONAL RESERVATION & CONFIRMATION OF RESERVATION
If Jannah Hotels & Resorts confirms the reservation this Contract is conditional on the Client supplying credit card details and the authority for charges to be deducted (including cancellation charges) on the payment terms outlined in the Schedule. If credit card details and payment authority is not given to Jannah Hotels & Resorts by the Client then subject to any outstanding obligation due to Jannah Hotels & Resorts from the Client the Contract will cease to be of effect. The Services that are the subject of the provisional reservation will be released and be resold without any further notification to the Client.

SUPPLY OF THE SERVICE
Jannah Hotels & Resorts shall provide the Services to the Client subject to the Contract. The Client shall at its own expense supply Jannah Hotels & Resorts with all necessary data or other information relating to the Services within sufficient time to enable Jannah Hotels & Resorts to provide the Services in accordance with the Contract. The Client shall ensure the accuracy of all such information. Specific information requirements are contained in the Schedule. Jannah Hotels & Resorts may, at any time, without notifying the Client, make any changes to the Services which are necessary to comply with any applicable safety or other statutory requirements, or which do not materially affect the nature or quality of the Services.

CHARGES
The charges payable by the Client shall be detailed in writing by Jannah Hotels & Resorts. If no charges are specified or additional and varied Services are provided to the Client, the Client shall pay the Standard Charges at the prevailing rate on the day the Services are provided and any additional sums which are agreed between the Jannah Hotels & Resorts and the Client for the provision of the Services. Jannah Hotels & Resorts may vary the Standard Charges from time to time. All charges quoted to the Client for the provision of Food and Beverage Services are inclusive of any Value Added Tax at the applicable rate at the tax point unless otherwise stated.

PAYMENT
The payments to Jannah Hotels & Resorts to be made by the Client (including Deposits) are to be made on the date(s) and in the amounts to be calculated as specified in the Schedule. If any services under the contract are varied prior to arrival then the payment made will reflect the latest details contained in the written details of Jannah Hotels & Resorts. Any additional charges due to Jannah Hotels & Resorts from the Client for the Services shall be paid by the Client on presentation of an invoice. Advance to Jannah Place: For room reservations made using the advanced purchase rate full payment will be taken at the time of booking. This payment is not refundable in the event of any amendment or cancellation. Cash Payment is not accepted for walk-in guests – a valid credit or debit card must be swiped through the chip and pin machine with adequate authorization taken. All charges to be settled prior the client leaving the hotel. The client is deemed to have authorized the settling of all outstanding charges which can be processed by the Hotel using any credit or debit card details held on file.

CANCELLATION CHARGES
The Client agrees to pay charges to Jannah Hotels & Resorts in the event of cancellation of the Services or if the Client and/or their guests fail to take up the Services at the time and on the day specified in the Contract. The cancellation charges are calculated by reference to the Schedule attached. Jannah Hotels & Resorts will provide a cancellation number to a Client in the event of the Client making a cancellation and that number must be used in any future dealings with Jannah Hotels & Resorts.

Variation in Service Required Any variation of numbers, accommodation and food and beverage requirements specified for the Services or other changes or additions must be agreed by the Client and Jannah Hotels & Resorts in writing.

LIABILITY OF JANNAH HOTELS & RESORTS
When Jannah Hotels & Resorts supplies the Services which include any services supplied by a third party, Jannah Hotels & Resorts does not give any warranty, guarantee or other term as to their quality, fitness for purpose or otherwise, but shall, where possible, assign to the Client the benefit of any warranty, guarantee or indemnity given by the person supplying the services to Jannah Hotels & Resorts.
Jannah Hotels & Resorts shall have no liability to the Client for any loss, damage, costs, expenses or other claims for compensation arising from any instructions supplied by the Client, which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from their late arrival or non-arrival, or any other fault of the Client. Except in respect of death or personal injury caused by Jannah Hotels & Resorts’ negligence, or as expressly provided in these Terms, Jannah Hotels & Resorts shall not be liable to the Client by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of Jannah Hotels & Resorts, its servants or agents or otherwise) which arise out of or in connection with the provision of the Services (including any delay in providing or failure to provide the Services) or their use by the Client, and the entire liability of Jannah Hotels & Resorts under or in connection with the Contract shall not exceed the amount of Jannah Hotels & Resorts’ charges for the provision of the Services, except as expressly provided in these Terms.

TERMINATION
Jannah Hotels & Resorts may (without limiting any other remedy) at any time terminate the Contract by giving written notice to the Client if the Client commits any breach of these Terms, or if the Client goes into liquidation, becomes bankrupt, makes a voluntary arrangement with its creditors or has a receiver or administrator appointed.

CLIENT RESPONSIBILITIES
Dress code: Guests are required to comply with the dress code of Jannah Hotels & Resorts. Arrival and departure times for accommodation at Jannah Hotels & Resorts are 2pm and 12pm respectively. The access and vacate times for all other Services will be as specified and must be strictly adhered to by the Client on all occasions. The Client is responsible for the behavior of his, her or its guests at Jannah Hotels & Resorts and in particular for the orderly conduct of guests attending any function or staying in Jannah Hotels & Resorts or otherwise making use of the Services. The Client must ensure that no noise or nuisance is caused either for Jannah Hotels & Resorts or its other guests and Clients. The Client must comply with any reasonable request of Jannah Hotels & Resorts and with any policies of Jannah Hotels & Resorts as may apply to the Services from time to time. Should a resident of the hotel wish for any item to be received or helped by Jannah Hotels & Resorts prior to arrival or following departure, advance notice will be required. The Hotel retains the right to deny receipt of such items. Any costs incurred for return will be borne by the sender. All items are left at the owners risk and may be subject to search. Please note that should an item be locked or sealed it is the responsibility of the owner of the item to facilitate access. Jannah Hotels & Resorts is not liable for any flood, fire or damage to the items. To ensure the comfort of our non-smoking guests, a charge will be applied for smoking in a non-smoking bedroom. All walk-in and same day booking guests must provide photographic identification on arrival regardless of their nationality. All visitors to guest accommodation must register on arrival and provide photographic identification.

CCTV
In the public areas of Jannah Hotels & Resorts and some Talents’ areas CCTV is in operation and video recordings may be made. This activity is carried out for security and service reasons for the better management of Jannah Place and security for all its Clients and staff.

GENERAL
The Contract constitutes the entire agreement between the parties, supersedes any previous agreement or understanding and may not be varied except in writing between the parties. All other terms, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law. No failure or delay by either party in exercising any of its rights under the Contract shall be deemed to be a waiver of that right, and no waiver by either party of any breach of the Contract by the other shall be considered as a waiver of any subsequent breach of the same or any other provision. UAE law shall apply to the Contract, and the parties agree to submit to the non-exclusive jurisdiction of the UAE courts.

 

FACEBOOK DATA COLLECTION
This policy describes the information we process to support Facebook, Instagram, Messenger and other products and features offered by Facebook.

I. What is Personal Data?

For the purposes of this Privacy Policy, “Personal Data” means any information provided by you when interacting with us, for example through our Website or when calling us, or data is collected about you through your use of our Website and allowing you to be identified personally, either directly (e.g. your name) or indirectly, because the data references an identifier such as your name, an identification number, location data, an online identifier (e.g. telephone number) as an individual person. We may also collect personal data about you in other instances which relate to your stay at Jannah Hotels & Resorts.

II. When is what kind of data stored and processed for what reason?

1. Use of the Website

Whenever you navigate our Website, data is collected and processed about you. We collect the following data:

  • Information related to the browser or device you use to access our website
  • IP address
  • Country you are browsing from
  • Browsing habits, including sites visited
  • Other demographics and statistical information

The data is collected through the session cookies (with regard to cookies see also below) we use on our Website. It is anonymised, before we use it to build anonymous utilisation profiles, for marketing purposes and to optimise our Website and the services we provide. This data shall not be used in order to identify the visitor of this Website personally.

2. Interacting with us

Every time you interact with us (e.g. booking a room through our Website, by phone or through a third party provider, posting a comment on our blog, signing up for our newsletter) we may collect and process the Personal Data you provide to us.

a. Booking a room

When you book a room, we collect Personal Data, which includes:

  • Your selected hotel
  • Your selected dates
  • Number of rooms in the reservation
  • Number of people in the reservation (adults and children)
  • Age of children
  • The rate/special offer selected
  • Any add-on packages selected
  • Your full name
  • Your address, including city and country
  • Your e-mail address, and
  • Your credit card details

Optional information

  • Frequent Flyer Information
  • Arrival Information
  • Room, Bed type and/or other preferences
  • Telephone/mobile
  • Option to join the Jannah Hotels & Resorts loyalty programme

We use this Personal Data to handle your reservation and to establish and fulfill our contract with you. This includes verifying your identity, taking guarantee and/or payment information, and sending stay-related and/or marketing communication.

We take the protection of your Personal Data very seriously and therefore have kept the mandatory required fields to a minimum.

b. “Contact Us” functionality

You can get in contact with us via our Website by using the “Contact Us” functionality, or by telephone. To contact us you are required to provide the following information:

  •  Your full name
  • Your zip code
  • Your telephone number and your e-mail address,
  • Your enquiry, and
  • Recaptcha, to confirm you are an actual person, and not a robot

Any additional information (e.g. home address) is provided voluntarily.

We use your information to reply to your enquiry.

3. Processing of Personal Data to personalise your stay at Jannah Hotels & Resorts

We may collect and process Personal Data about you if it is relevant for your stay in a Jannah Hotels & Resorts or if it is in your interest. We may collect and process certain additional data to personalise your stay upon your express request and consent.

SOCIAL MEDIA

On our Website we use the following social media plug-ins integrated through cookies: Facebook, Instagram, Twitter, LinkedIn, WhatsApp, YouTube. The plug-ins can be identified by the social media buttons marked with the logo of the provider of the respective social media networks

We have implemented these plug-ins using our own solution. This means that when you navigate on our Website, Personal Data will initially not be collected by the providers of these social media plug-ins. Only if you click on one of the plug-ins will your Personal Data be transmitted: By activating the plug-in, data is automatically transmitted to the respective plug-in provider. We neither have influence on the collected data and data processing operations conducted by the providers, nor are we aware of the full extent of data collection, the purposes or the retention periods.

The plug-in provider stores the data collected about you as user profiles and uses them for the purposes of advertising, market research and/or demand-oriented design of its website. Such an evaluation is carried out in particular (also for users who are not logged in) for the purpose of presenting need-based advertising and to inform other users of the social network about your activities on our Website. You have the right to object to the creation of these user profiles, whereby you must contact the respective plug-in provider to exercise this right. Through the plug-ins, we offer you the opportunity to interact with the social networks and other users, so that we can improve our offer and make it more interesting for you as a user.

The data is passed on regardless of whether you have an account with the plug-in provider and are logged in. If you are logged in with the plug-in provider, your data collected by us will be directly assigned to your account with the plug-in provider. We recommend that you log out regularly after using a social network, but especially before activating the button, as you can then avoid being assigned to your profile with the plug-in provider.

Information on the purpose and scope of data collection and its processing by the plug-in provider can be found in the respective privacy policies, where you will also find further information on your rights and options for the protection of your personal data.

Information and content you provide. We collect the content, communications and other information you provide when you use our Products, including when you sign up for an account, create or share content, and message or communicate with others. This can include information in or about the content you provide (like metadata), such as the location of a photo or the date a file was created.

Device Information

As described below, we collect information from and about the computers, phones, connected TVs and other web-connected devices you use that integrate with our Products, and we combine this information across different devices you use.

Cookie data: data from cookies stored on your device, including cookie IDs and settings.
